Acceptance of Terms
By contacting, scheduling, or receiving services from Septi Clear Inc. (“Septi Clear,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service. This agreement applies to all individuals and entities who use our services, visit our website at septiclearinc.com, or otherwise engage with us in connection with septic system work.
If you do not agree with any part of these terms, please do not book or receive services from Septi Clear.
Note: These terms form a legally binding agreement between you and Septi Clear Inc., headquartered at 6233 SE Fern Ave, Portland, OR 97206-9534.
Services Provided
Septi Clear provides professional septic system services throughout Oregon, including but not limited to:
- Septic tank pumping and cleaning
- Septic system inspections and evaluations
- Drain field testing, repair, and restoration
- Septic system installation and replacement
- Emergency septic services
- Maintenance plans and routine servicing
- Grease trap and holding tank services
- Compliance inspections for real estate transactions
The scope of each job will be outlined at the time of booking or in a separate written estimate or service agreement. Services may vary based on system type, local regulations, and site conditions. Septi Clear reserves the right to decline or discontinue any service at its sole discretion.
Scheduling & Cancellations
Appointments. Service appointments are scheduled based on availability and are subject to change due to weather, equipment issues, or other unforeseen circumstances. We will make reasonable efforts to notify you of any changes in advance.
Cancellations by Client. If you need to cancel or reschedule, we ask for a minimum of 24 hours’ notice prior to your scheduled appointment. Cancellations made with less than 24 hours’ notice may be subject to a cancellation or trip fee, which will be communicated at the time of booking.
No-Access Situations. If our team arrives at the scheduled time and cannot access the property or the septic system due to circumstances within the Client’s control (locked gates, uncleared access, absent authorization, etc.), the visit may be treated as a missed appointment and billed accordingly.
Cancellations by Septi Clear. In rare cases, we may need to reschedule due to emergency jobs, equipment failures, or crew availability. We will contact you promptly and prioritize rescheduling at your earliest convenience.
Site Access & Client Responsibilities
To perform services safely and effectively, the Client agrees to:
- Provide clear, unobstructed access to the property, the septic system, and all relevant components (tank lids, cleanouts, distribution boxes, etc.).
- Disclose the known location of the septic tank, drain field, and any underground utilities or structures that may affect the work.
- Inform Septi Clear of any known hazards, dangerous animals, or restricted areas on the property prior to arrival.
- Ensure that all persons and pets are kept clear of the work area during service.
- Obtain any necessary permissions or easements required for us to access the job site.
Septi Clear is not responsible for damage to driveways, landscaping, irrigation systems, or other surface features that results from normal service operations, particularly where access conditions are narrow, soft, or otherwise challenging. We will take reasonable care to minimize disturbance.
Important: Providing false or incomplete information about site conditions or system history may result in incomplete service, additional charges, or termination of the service visit.
Payment Terms
Pricing. Pricing for services is provided via quote, estimate, or our published rate schedule. Final invoiced amounts may differ from estimates if additional work or materials are required, and any changes will be communicated to the Client before proceeding.
Payment Due. Payment is due in full at the time of service completion unless a separate billing arrangement has been agreed upon in writing. Accepted payment methods include cash, check, and major credit or debit cards. Additional methods may be available – please inquire at the time of booking.
Late Payments. Balances not paid within 30 days of the invoice date may be subject to a late fee and/or referral to a collections process. Septi Clear reserves the right to suspend future service to accounts with outstanding balances.
Disputed Charges. If you believe a charge is in error, please contact us within 14 days of receipt of your invoice. We are committed to resolving billing concerns promptly and fairly.
Limitation of Liability
Septi Clear strives to deliver professional, high-quality septic services. However, to the fullest extent permitted by applicable Oregon law:
- We are not liable for pre-existing damage, defects, or failures in your septic system that were present before our service visit.
- We are not responsible for consequential, incidental, or indirect damages arising from the performance of – or failure to perform – our services, including but not limited to property damage unrelated to our work, loss of use, or business interruption.
- Our total liability for any claim arising out of a single service event shall not exceed the amount paid by the Client for that specific service.
Nothing in these terms limits liability for gross negligence or willful misconduct on the part of Septi Clear or its employees.
Warranty & Service Guarantee
Septi Clear stands behind the quality of our work. Where a specific warranty or satisfaction guarantee is offered, it will be communicated to you in writing at the time of service.
General limitations on warranties include:
- Warranties apply only to the specific work performed by Septi Clear and do not extend to components not serviced or pre-existing conditions.
- Warranty coverage may be voided if the system is modified, misused, or serviced by a third party after our visit without our prior written consent.
- No warranty is implied for emergency services or services performed under conditions of limited access or information.
If you are unsatisfied with any aspect of our service, please contact us within 7 days so we can assess the situation and work toward a resolution.
Third-Party Services & Permits
Certain septic projects – particularly installations, repairs, or expansions – may require permits from Oregon DEQ, county health departments, or local municipalities. The Client is responsible for obtaining all required permits unless a written agreement specifies that Septi Clear will handle permitting on the Client’s behalf.
Septi Clear may engage licensed subcontractors or specialty vendors for certain aspects of a project. We remain responsible for the overall quality of work delivered, but subcontractors operate under their own license and carry their own insurance.
We are not responsible for delays or increased costs caused by regulatory agencies, utility locating services, or other third parties beyond our reasonable control.
Hazardous Conditions
Septic systems can involve exposure to harmful gases (including hydrogen sulfide and methane), raw sewage, and other biological or chemical hazards. Our technicians follow established safety protocols at all times.
If our crew encounters conditions that pose an unreasonable risk to personnel safety – such as structural instability, confined space hazards, or the presence of unknown chemicals – Septi Clear reserves the right to halt work immediately. The Client will be notified, and the job may be rescheduled, modified, or declined pending resolution of the safety concern.
Safety first: Never enter a septic tank, vault, or similar confined space without proper training and equipment. If you suspect a gas leak or sewage emergency on your property, evacuate the area and call emergency services before contacting us.
Intellectual Property
All content on the Septi Clear website – including text, graphics, logos, images, and service descriptions – is the property of Septi Clear Inc. and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, republish, or create derivative works from any Septi Clear content without prior written permission. Requests for use of our content for educational, journalistic, or other purposes should be directed to [email protected].
Privacy & Data Use
When you contact us, book a service, or use our website, we may collect personal information such as your name, address, phone number, email address, and information about your property and septic system.
This information is used solely to:
- Schedule and perform the services you have requested.
- Communicate with you regarding appointments, invoices, and follow-ups.
- Maintain service records for regulatory compliance and future reference.
- Improve our services and customer experience.
We do not sell, rent, or share your personal information with third parties for marketing purposes. Information may be shared only as required by law or with service providers directly assisting in the delivery of your requested services. Dispute Resolution
We genuinely want every client to be satisfied, and we encourage you to reach out to us directly before pursuing any formal action. Most concerns can be resolved quickly through a direct conversation.
If a dispute cannot be resolved informally, the parties agree to attempt resolution through non-binding mediation in Multnomah County, Oregon, before initiating any legal proceedings. Each party will bear its own costs for mediation unless otherwise agreed.
If mediation does not resolve the dispute, either party may pursue available legal remedies in the appropriate state or local courts of Oregon.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict-of-law provisions. Any legal action or proceeding relating to these terms shall be brought exclusively in the courts of Multnomah County, Oregon, and both parties consent to personal jurisdiction in those courts.
Changes to These Terms
Septi Clear reserves the right to update or modify these Terms of Service at any time. Changes will be posted on our website at septiclearinc.com. Your continued use of our services after any update constitutes your acceptance of the revised terms.
For significant changes that may materially affect your rights or obligations, we will make reasonable efforts to notify existing clients by email or phone.
